Industry Urges Review of US Trade Deal After SC Tariff Ruling

Following the US Supreme Court’s decision to overturn Trump’s tariffs, domestic industry and experts expressed some relief, arguing that it might aid India in negotiating a better deal.

The 25% penal duties have been removed, but US President Donald Trump has put 50% tariffs on Indian products.

Following the finalization of the interim agreement, the United States will reduce the additional charge to 18 percent. In contrast, Indian business was beginning to feel better after the US Supreme Court’s ruling.

The “judicial adjustment” improves India’s bargaining position, according to Saurabh Agarwal, tax partner at EY India. We regard this as a good thing because it gives India the opportunity to accelerate its production without worrying about arbitrary trade restrictions.

Our goal is still to turn this into a comprehensive bilateral trade agreement that protects India’s key domestic goals and respects reciprocal market access.

Section 232 charges, however, continue to have an impact on industries including steel, aluminum, and autos. The verdict should force India to reevaluate its trade agreement with the United States, according to the trade research organization GTRI.The ruling essentially makes current trade agreements that the US has started or completed with the UK, Japan, the EU, Malaysia, Indonesia, Vietnam, and India unfair and pointless.

It stated that partner nations might now have grounds to back out of these agreements.By severely limiting the president’s ability to use tariffs as a weapon and altering how future administrations use emergency economic powers, this decision against Trump will reclaim Congress’s dominance in trade policy,” the statement continued.

The court made no such observation, despite the fact that the decree has increased expectations that exporters will receive refunds. In order to process the refunds, the matter will now return to the Court of International Trade.
